Policeman accused of rape and attempting to lure a teenager into a threesome

This week, the court heard that PC Marc Forth, 42, of Nuneaton had sex with two women whose cases he was investigating, and tried to persuade them to join a ‘threesome’ with him and his girlfriend. Directing the jury to return a not guilty verdict on a charge of misconduct in a public office, the judge explained that the investigation was over by the time the relationships began. However, it is clear that the officer’s actions demonstrate a tendency to prey on vulnerable women. And this isn’t even the worst of it.

His predatory urges still not satisfied, the Coventry-based police officer is also alleged to have raped another woman, incited a 15-year-old babysitter to take part in sexual activity with him and his then partner, and sexually assaulted another 15-year-old.

Prosecutor Michael Shaw told the jury: “Forth is a controlling, sexually aggressive, assertive man who took the opportunities presented to him as a police constable.

“He [sought to persuade] women who he knew were vulnerable to engage in sex with him and with him and his partner.

“That has the potential to undermine the prosecution of the perpetrator of domestic violence, because an investigating officer is meant to be independent, and it brings the force into disrepute.”

Propositioning vulnerable women

The jury heard how the first woman called the police in 2006 because of alleged violence by her ex-husband, and when Forth went to her home to speak to her about it, ‘she was impressed by his professionalism’ and wrote to the force commending him.

Forth visited her again the following week, but did not stay long, and later contacted her when he was off-duty using the number he had obtained as part of the investigation.

“The conversation became flirty, and about two weeks after this he drove to her property in Coventry and collected her, and they embarked on a consensual sexual relationship.

“We say that is something he should not have done and amounts to misconduct in his office as a constable.”

She ended it when she moved out of Coventry, but they made contact again in 2010 after he posted his condolences on a commemorative site following the death of her mother.

When they met at a coffee shop, Forth brought along his then-partner – and she was taken aback when the conversation turned to sex and Forth and his partner suggested ‘a threesome’ which the woman refused.

The second woman contacted the police in May 2013 as a result of domestic abuse. Forth was assigned to deal with it. He spoke to her and engaged in consensual sexual activity with her after he contacted her while off-duty that evening.

“She described him as being professional, but that he became flirty and mentioned his partner and suggested they all get together ‘for some fun.’

“He called her later and said he had spoken to her ex-boyfriend and told him to stay away. He then visited her flat and suggested she meet [his girlfriend], and she and Forth had consensual sex at the flat.”

It was alleged Forth later visited the flat again with his girlfriend, and that they spoke to her about the possibility of engaging in joint sexual activity – but she declined, and Forth then stopped calling or texting her.

A third woman whose case had been assigned to Forth was propositioned for sex within 20 minutes of him arriving at her home but she ‘declined the offer,’ and so there was no charge in relation to her.

Preying on children

In a sick twist which makes the above events seem mild, Forth and his girlfriend got talking to a 15-year-old girl at a restaurant and asked her to babysit for them, which she began to do.

She was usually driven home afterwards, but on the last occasion she did so she was asked to stay over that night because they would have been drinking, and she slept in the spare room.

“The following morning she asked to use the shower before going home. That was in the master bedroom, and when she emerged Forth was lying on the bed with [his girlfriend].

“She recalled him saying ‘Come on, let’s have some fun.’ She said she was only 15, and he said ‘I won’t tell if you don’t,’ and he pulled her towards him.

“She resisted, and she describes him then starting to touch [his girlfriend] sexually in front of her.”

These allegations all emerged when an investigation began after another girl told her mother that Forth had touched her upper thigh between the legs when she was eight or nine. In a video interview recorded prior to the trial, she disclosed that he had also touched her more intimately.

Rape and penetration by foreign object

Saving the worst for last, the court heard that Forth had allegedly raped that girl’s mother, who had met him through a mutual friend, when she was at his home at the time in the Tuttle Hill area of Nuneaton.

She said there had been a large chocolate bar, and when she had picked it up Forth told her ‘If you bite that, you’ll regret it.’
